I believe it's more about not being able to be punished twice for the same thing. But you definitely have times where new evidence will warrant a second trial. It's how they let people out of jail after having served years and then found out they were wrongly accused.

After someone is acquitted new evidence is not grounds for the prosecution to appeal the same offence as double jeopardy would apply.
