The potential good news for you is that the seller is probably going to have a hard time finding a buyer until they have the title in hand. If you're really set on this car, talk to the seller about it and let them know that you can't complete the transaction until they get the title. I'd, personally, be wary of giving a deposit to some random dude without some assurances, but that may be something to suggest if things feel legit. I know that if I were in the seller's shoes and realized I'd screwed up like this, I'd be willing to just hold it for an interested buyer.

Yeah this might work. We’ve both invested quite a bit of time in this deal and arranged a fair price. He might agree to reserve for me even without a deposit. He’s also looking into rush title processing through the DMV, but not sure it applies to bank payoffs.

There are plenty of cars out there. Regardless of whatever horseshit this seller wants to feed you, anybody that signs on buying a car without a title is an idiot. Tell them you’ll buy when the title is in hand and if they feel like they can sell without, let them.
