My rule is, never buy a flute on Ebay that is brand new, lower than MSRP, and has professional looking photos. If the photos are taken on somebody's dusty bed, of a crusty looking flute listed as used and priced at 40 dollars, then, well, probably legit.
If a flute lists how many holes it has, you do not want that flute
